Introduction

Welcome to Pulse (also known as Wellness OS), published as WOS: AI Health Coach on Google Play (package com.d73.stillalive) ("we," "our," "us," or "the App"). The App is a personal wellness companion that helps you reflect on and track six everyday areas — sleep, mind, fitness, nutrition, hydration, and fasting — and provides AI-powered coaching, insights, reminders, chat, and an optional live voice call with an AI coach, based on the information you choose to share.

BY USING THE APP, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE APP.

These Terms form a binding agreement between you and us and include our Privacy Policy by reference. They apply to both the iOS version (Apple App Store) and the Android version (Google Play). Where a practice applies to only one platform, this is stated.

1. Who Can Use This App

1.1 General Eligibility
You must be at least 13 years old and able to form a legally binding agreement in your jurisdiction to use the App.

1.2 Not Directed to Children
The App is not directed to children under 13 years of age. If we learn that a user is under 13, we will terminate their access.

1.3 Your Responsibilities
You are responsible for:

Ensuring your device is secure (passcode, Face ID, Touch ID, or Android screen lock)
Choosing appropriate settings (reminder frequency, alert preferences, AI features, voice features, Apple Health access on iOS)
Providing accurate information during personalization (e.g., age, height, weight, goals) so the App can personalize coaching
Reviewing AI-generated coaching, insights, and chat responses with your own judgment
Managing Apple Health permissions in iOS Settings → Privacy & Security → Health → Wellness OS (iOS only)

2. What We Provide

2.1 Core Features
The App provides:

Six personalized wellness coaches — Sleep, Mind, Fitness, Nutrition, Hydration, and Fasting
A daily Wellness Score that summarizes how your six coaches are doing
Per-coach tracking, insights, suggested actions, and AI-powered chat
Cross-coach insights that surface patterns across the six areas (for example, links between sleep and mood)
An optional live voice call with your AI coach, where your microphone audio is streamed in real time to our AI provider (OpenAI) so the coach can understand you and respond by voice — see Section 4.5
Voice logging with speech transcription (some flows transcribe entirely on your device; some longer-form flows briefly upload audio to a transcription provider — see Section 4.5)
Optional sleep sound sensing that uses your microphone during a sleep session to detect snoring and room noise; audio is analyzed on your device and short snore clips are saved only on your device — see Section 4.7
Camera meal logging using AI vision to extract food items, macros, or container volume
Optional Apple Health (HealthKit) integration (iOS only) that lets the App read selected health and fitness data from Apple Health (and, optionally, write your manual logs back) so you don't have to re-log what your Apple Watch, smart scale, ring, or other Health-connected devices already track. The Android version does not connect to Apple Health, Health Connect, Google Fit, or any other health platform
Optional push notification reminders (if enabled by you on iOS or Android)
Optional Widgets (and, on iOS, Live Activities) that display summary scores and ongoing sessions (e.g., fasting timer) on your Home Screen and Lock Screen
A unified personalization flow that adapts the App to your goals, schedule, body, dietary style, training level, fasting protocol, and other preferences

2.2 Advertising in the App

On iOS, the App shows no in-app advertisements.
On Android, the App shows advertisements through Google AdMob, including rewarded ads you may choose to watch to earn in-app credits. See Section 8.4 and the Privacy Policy for details. On both platforms we may separately measure whether our own acquisition ads led to installs (ad attribution), which is different from showing ads inside the App.

2.3 Premium Features
A premium subscription may include:

Full access to advanced insights and analyses across the six coaches
Higher AI chat and voice-call usage limits
Advanced reminder and notification options
Additional customization features
Priority support
Other features as described in-app at time of purchase

2.4 Feature Changes
We reserve the right to modify, add, or remove features at any time, including:

Adding or removing coaches, tabs, or sections
Changing limits on AI usage, voice calls, reminders, or other features
Adding or removing premium features
Changing eligibility requirements for features
We will make reasonable efforts to notify users of material changes.

2.5 Service Availability
The App requires an internet connection for certain features (syncing logs, AI coaching, live voice calls, insights, subscription verification, and — on iOS — Apple Health sync to our servers). We do not guarantee uninterrupted availability.

3. No Medical / Emergency Guarantee

3.1 Not an Emergency Service or Medical Device
The App is NOT:
❌ An emergency service (not 911 or emergency medical services)
❌ A medical device or health monitoring system
❌ A substitute for professional medical advice, diagnosis, or treatment
❌ A personal safety alarm or security system
❌ A replacement for emergency contacts or safety planning
❌ A mental health treatment or therapeutic tool
❌ A clinical interpretation of Apple Health data (heart rate, HRV, blood glucose, sleep stages, or any other metric)

3.2 AI Coaching Disclaimer
The coaching messages, daily actions, insights, chat responses, and live voice-call responses generated by the App are produced by artificial intelligence based on your self-reported inputs and, if you grant access, data read from Apple Health. They are NOT:
❌ Medical advice, diagnosis, or treatment recommendations
❌ Professional counseling or therapy
❌ Evidence-based clinical guidance
❌ Intended to detect, prevent, or treat any medical or mental health condition

AI outputs are based solely on the information you provide (and any Apple Health data you choose to share) and the limitations of the underlying models. They are for informational and motivational purposes only and may be incorrect, incomplete, or out of date.

⚠️ IMPORTANT: If you are experiencing a medical or mental health emergency:

Call emergency services (911 in US)
Contact a mental health crisis line (988 Suicide & Crisis Lifeline in US)
Seek immediate professional help
Always consult qualified healthcare professionals before making changes to your diet, exercise routine, sleep schedule, fasting practice, or mental wellness approach — especially if you have a medical condition, are pregnant or nursing, are taking medication, or are under 18.

3.3 No Guarantee of Delivery
We do not guarantee that:

Coach reminders will always be delivered on time
Notifications, alerts, or email messages will be sent or received
Live voice calls will connect or remain uninterrupted
The App will function during network outages, device issues, or service disruptions
Logs, insights, or scores will sync successfully
Apple Health data will sync successfully or be interpreted correctly (iOS)
AI-generated content will always be accurate, helpful, or appropriate
Reminders, notifications, AI responses, voice calls, Apple Health syncs, and other outputs may be delayed, blocked, fail, or contain errors due to factors outside our control, including but not limited to:

iOS or Android notification, microphone, or HealthKit permissions being disabled
Device being turned off, in airplane mode, or out of battery
Network connectivity issues
Email delivery failures or spam filtering
Carrier restrictions or blocking
Server outages or maintenance
Software bugs or conflicts
Third-party AI service limitations (OpenAI, Anthropic, Google)
Third-party voice transcription service issues (Deepgram)
Third-party analytics service issues (Mixpanel)
Third-party subscription service issues (RevenueCat)
Third-party advertising service issues (Meta SDK, Firebase Analytics / Google, Google AdMob)
Apple Health / HealthKit framework changes, permission revocations, or sync delays (iOS)

3.4 You Are Responsible for Your Health and Safety
You agree:
✅ Not to rely on the App as your only source of wellness or health guidance
✅ To consult a licensed healthcare provider before making changes to diet, exercise, sleep, fasting, or mental wellness routines
✅ To use your own judgment when reading or listening to AI-generated coaching, insights, chat, or voice-call responses
✅ To test notifications and reminders to ensure they work as expected
✅ To maintain other emergency contact methods (phone, text, 911)
✅ Not to use the App as a substitute for professional mental health or medical care
✅ Not to rely on Apple Health values surfaced in the App for medical decisions

4. Wellness Coaches, Tracking, and Scores

4.1 The Six Coaches

The App provides six coaches: Sleep, Mind, Fitness, Nutrition, Hydration, and Fasting
Each coach has four sections — Track, Insights, Actions, and Coach (chat)
You may use any combination of coaches; you do not have to use all six

4.2 Logging

You may log entries in each coach (for example, a sleep entry, a meal, a workout, a water log, a fasting window, a mood check-in)
Logs may be entered by tapping fields, by speaking (voice transcription), during a live voice call, by taking a photo (camera meal logging), or — on iOS, if you grant Apple Health access — automatically from devices and apps connected to Apple Health
Logs are stored on your device and on our servers so the App can show your history, calculate scores, and personalize coaching

4.3 Scores

The App calculates a per-coach score and a cross-coach Wellness Score
Scores are based on your self-reported inputs and, on iOS if you grant access, Apple Health data, and are for personal tracking only
Scores are not medical assessments and should not be interpreted as such
We do not guarantee score accuracy in all cases (for example, during clock changes, device migrations, missing data, Apple Health sync gaps, or bugs)

4.4 AI Coaching, Insights, Chat, and Voice Calls

The App generates personalized coaching messages, daily actions, weekly summaries, chat responses, and live voice-call responses using third-party AI services (OpenAI, Anthropic, Google Gemini)
Relevant context from your profile, your recent logs, and — on iOS if you have granted Apple Health access — short summaries of your recent Apple Health data (for example, last night's sleep duration, today's steps, recent HRV, today's water total, most recent blood glucose) may be sent to these services for a single request to generate personalized output
During a live voice call, your microphone audio is streamed in real time to OpenAI so the coach can understand you and generate a spoken response (see Section 4.5)
AI outputs are informational only and may be incorrect, incomplete, or out of date
You can choose whether and how often to use AI features
You may at any time disable Apple Health access in iOS Settings, which will stop Apple Health data from being included in AI prompts going forward

4.5 Voice and Camera (Optional Features)

For most voice logging, your speech is transcribed entirely on your device using on-device speech recognition — audio is not uploaded
For certain longer-form voice features (for example, the sleep "describe your night" flow and the goal-planning voice intake), the audio recording may be sent to our transcription provider (Deepgram) for a single transcription request, after which the audio is not retained on our servers and the resulting text is stored with your log
For the live voice call, your microphone audio is streamed in real time to our AI provider (OpenAI) for the duration of the call so the coach can understand you and respond by voice. We do not retain the raw call audio on our servers; a text transcript and/or summary of the call is stored with your account so the coach has continuity across sessions. The live call uses OpenAI, not Deepgram
Camera meal logging sends the photo to our AI vision provider (OpenAI or Google) for that single request; photos are not retained on our servers after processing unless you save them with the log
You may use the App without voice or camera features

4.6 Apple Health (HealthKit) Integration (iOS Only)

Apple Health integration is available only on iOS and is optional. You will only be asked once during onboarding (or later in Settings) for access, and the App functions without it. The Android version does not connect to Apple Health, Health Connect, Google Fit, or any other health platform
If you grant access, the App may read the following categories of data from Apple Health: sleep analysis (including stages), heart rate, resting heart rate, heart rate variability (HRV), respiratory rate, steps, active energy, VO₂ max, exercise minutes, stand hours, workouts (type, duration, energy, distance), mindful minutes, body mass (weight), body fat percentage, height, dietary energy, dietary protein, dietary carbohydrates, dietary fat, dietary water, and blood glucose
If you separately enable write-back, the App may write your manual logs (water, calories, protein, carbohydrates, fat, mindful sessions, weight) back to Apple Health so the data appears in Apple's Health app and other apps you have connected. Write-back is off by default
The App requests permission to receive background updates from Apple Health so that new data added by your watch, ring, smart scale, or other devices can flow into the App without you opening it
Daily summaries of the data you have granted may be uploaded to our servers (stored under your Device ID in your private user space) so the App can compute scores and generate AI coaching. We do not sell your Apple Health data, do not use it for advertising, and do not share it with data brokers or in-app ad providers
You may revoke any data category at any time in iOS Settings → Privacy & Security → Health → Wellness OS
You may request deletion of all Apple Health data we have stored on our servers using the in-app delete control or by contacting us; this is separate from deletion of your wider account

4.7 Sleep Sound Sensing (Optional)

If you start a sleep session with sound sensing enabled, the App uses your device's microphone to listen for snoring and room noise while you sleep
The audio is analyzed on your device in real time; we keep only aggregate figures such as snore minutes and noise levels as part of your sleep log
The App may save a small number of short snore clips on your device only, so you can listen back in the morning. These clips stay on your device, are never uploaded to our servers, are never sold, and are automatically deleted after a few days
Sound sensing runs only during an active sleep session and only if you enable it

5. Personalization and Your Profile

5.1 Personalization Flow
During onboarding and at any time afterwards, you may provide profile information including age or age range, gender, height, weight, wake time, bedtime, activity level, goals, dietary style, allergies, training level, equipment access, fasting protocol, chronotype, and topics you want help with.

This information is used solely to personalize your coaches, set realistic targets, and improve the coaching you receive. A Privacy Policy link is available in onboarding and in Settings before and while you provide this information.

5.2 Accuracy
You are responsible for the accuracy of the information you provide. Inaccurate profile data may result in inaccurate or inappropriate coaching.

5.3 Updating Your Profile
You can review and update your profile information at any time in Settings.

6. Subscriptions & Payments

6.1 Billing

On iOS, all payments are processed through the Apple App Store. On Android, all payments are processed through Google Play Billing
We do not directly handle or store your payment card details
Subscription management (purchase verification, renewal status, trial tracking) is handled by RevenueCat on our behalf. RevenueCat receives anonymized subscription event data tied to a RevenueCat-generated user identifier — no payment card details are shared with RevenueCat
Subscription pricing is shown in the App Store / Google Play and in the in-app purchase flow
Prices may vary by region and are subject to change

6.2 Subscription Plans
Premium is available as a weekly, monthly, or yearly auto-renewing subscription. Pricing and any available free trial are displayed in the App at the time of purchase.

6.3 Auto-Renewal

Subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period
Your Apple ID or Google Play account will be charged for renewal within 24 hours prior to the end of the current period
You will be charged the then-current subscription price

6.4 Managing Subscriptions
You can manage or cancel your subscription:

iOS: Settings → [Your Name] → Subscriptions, or through the App Store app
Android: Google Play app → Profile → Payments & subscriptions → Subscriptions

6.5 Cancellation

Canceling stops future billing but does not provide a refund for the current period
You retain premium access until the end of the current billing period
After cancellation, premium features will be disabled when the subscription expires

6.6 Free Trials and Promotional Offers

A free trial may be offered for some plans (for example, on weekly, monthly, or yearly subscriptions)
Additional free trials or promotional discounts may be offered from time to time
Trial periods and terms are displayed at time of purchase
You will be charged the full subscription price after the trial ends unless you cancel before the trial period expires
Trial eligibility is determined by Apple or Google and may be limited to first-time subscribers

6.7 Refunds

Refund requests are handled by Apple (iOS) or Google (Android), not by us
To request a refund on iOS, visit reportaproblem.apple.com or contact Apple Support; on Android, use Google Play's refund process
We cannot guarantee refund approval as this is determined by Apple's or Google's policies

6.8 Subscription Changes

We may change premium features, pricing, or subscription tiers at any time
Changes will apply to new subscriptions or renewals after the effective date
You will be notified of material changes where required by law

7. Acceptable Use

You agree to use the App lawfully and responsibly. Prohibited uses include:

❌ Harassment and Abuse

Using the App, including any social or community features we may offer, to harass, threaten, stalk, or intimidate others
Sending unwanted or abusive messages
Submitting unlawful, hateful, sexual, or otherwise inappropriate content to the AI coach, including during voice calls

❌ Unauthorized Access

Accessing accounts or data you are not authorized to access
Attempting to impersonate other users

❌ Technical Abuse

Reverse engineering, decompiling, or modifying the App
Using automated scripts, bots, or tools to abuse features
Tampering with server communications or API endpoints
Attempting to gain unauthorized access to our systems
Manipulating or gaming the scoring, AI, in-app credit, or advertising features
Submitting falsified or third-party Apple Health data not belonging to you

❌ Fraudulent Activity

Creating fake accounts or impersonating others
Providing false information during signup or use
Exploiting bugs or vulnerabilities for personal gain (including in-app credits or rewarded ads)
Sharing premium features through account-sharing schemes

❌ Misuse of AI

Using AI features (chat or voice) to generate content that is unlawful, harmful, hateful, sexual, or otherwise inappropriate
Attempting to extract or reverse engineer the underlying AI models

Violations may result in:

Immediate suspension or termination of your access
Deletion of your account and data
Referral to law enforcement if illegal activity is suspected

8. Privacy & Data

8.1 Privacy Policy Governs Data Use
Your use of the App is governed by our Privacy Policy, which explains:

What data we collect (Device ID, profile data, wellness logs, AI chat content, voice-call transcripts, Apple Health data you choose to share on iOS, subscription state, anonymized analytics, etc.)
How we use data (app functionality, personalization, AI coaching and live voice calls via OpenAI, Anthropic, and Google; voice transcription via Deepgram; analytics via Mixpanel; subscription management via RevenueCat; advertising attribution via Meta and Google Firebase; and in-app advertising on Android via Google AdMob)
How data is stored (on-device and server-side)
Your privacy rights and choices

8.2 You Acknowledge Data Collection
By using the App, you acknowledge and consent to:

Collection of Device ID for authentication
Storage of your profile and wellness logs across the six coaches
On iOS, if you grant Apple Health access: reading the data categories listed in Section 4.6, uploading daily summaries of that data to our servers under your Device ID, and including relevant summaries in AI prompts
Sending relevant context from your profile, logs, and (on iOS, if granted) Apple Health summaries to AI providers (OpenAI, Anthropic, Google) to generate coaching, insights, and chat responses
Streaming your microphone audio to OpenAI during a live voice call, and storage of the resulting transcript/summary with your account
Sending audio recordings to Deepgram for transcription when you use the longer-form voice features described in Section 4.5
On-device processing of microphone audio for sleep sound sensing, with short snore clips stored only on your device (Section 4.7)
Anonymized analytics via Mixpanel (screen views, feature usage, app performance — no Apple Health values, no wellness log values, no AI chat or voice-call content)
Subscription state being managed and verified via RevenueCat
Collection of advertising attribution data via Meta (Facebook) SDK and Firebase Analytics (Google), subject to your App Tracking Transparency permission choice (iOS)
On Android, display of in-app ads via Google AdMob, which may process your Google Advertising ID
Anonymous conversion signals sent to Apple's SKAdNetwork for ad measurement (always, regardless of ATT permission — this is required by Apple's privacy framework and contains no personal data)
Display of summary scores and ongoing sessions in Widgets and (on iOS) Live Activities on your Home and Lock Screens (no raw Apple Health values are placed in widgets)
All data practices described in the Privacy Policy

8.3 Third-Party AI Services and Live Voice Calls
You acknowledge that:

AI coaching, insights, chat, and live voice-call responses are generated using third-party AI APIs from OpenAI, Anthropic, and Google
Relevant context from your profile, recent logs, and (on iOS, if you have granted Apple Health access) short summaries of your recent Apple Health data may be sent to these services for a single request
During a live voice call, your microphone audio is streamed to OpenAI for the duration of the call
These services are subject to their own terms and privacy policies
We do not control these services' processing or availability
AI-generated content may not always be accurate, appropriate, or helpful
Apple Health data and voice-call audio sent to these services are sent only as part of generating a response for you and are not used to train third-party models, sold, or used for advertising

8.4 Analytics and Advertising Services
You acknowledge that:

We use Mixpanel for product analytics. Anonymized usage data (screen views, feature interactions) is sent to Mixpanel. No personally identifiable information (names, wellness logs, AI chat or voice-call content, Apple Health values) is sent to Mixpanel. Mixpanel's services are subject to their terms and privacy policy
We use Meta (Facebook) SDK for advertising attribution. When you install or use the App after seeing one of our ads, the Meta SDK may report this conversion to Meta Platforms. On iOS, if you grant tracking permission via Apple's App Tracking Transparency prompt, this may include your device's advertising identifier (IDFA); if you deny permission, only aggregated / anonymized signals are sent via Apple's SKAdNetwork framework. On Android, the Google Advertising ID may be used unless you reset or delete it. No Apple Health data is ever shared with Meta
We use Firebase Analytics (Google) for advertising attribution and app analytics. Usage events (such as app opens and subscription starts) are reported to Google to measure ad campaign performance. No Apple Health data is ever shared with Firebase Analytics
On Android only, the App displays in-app advertisements through Google AdMob, including rewarded ads you may watch to earn in-app credits. AdMob may process your Google Advertising ID and ad-interaction signals to serve and measure these ads. The iOS version shows no in-app ads. No Apple Health data, wellness logs, or voice-call content is shared with AdMob
On iOS 14 and later, we will ask for your permission before tracking you across apps and websites owned by other companies. You can change this at any time in iOS Settings → Privacy & Security → Tracking. On Android, you can reset or delete your Google Advertising ID in Android Settings → Google → Ads

8.5 Subscription Management Services
You acknowledge that:

We use RevenueCat for subscription verification and management on both platforms
Anonymized subscription event data is shared with RevenueCat to verify your premium status
No payment card details and no Apple Health data are shared with RevenueCat
RevenueCat's services are subject to their terms and privacy policy
We do not control RevenueCat's availability; service disruptions may temporarily affect premium feature access

8.6 Voice Transcription Service
You acknowledge that:

For longer-form voice features (sleep "describe your night," goal-planning voice intake), the audio recording is sent to Deepgram for a single transcription request
Audio is not retained on our servers after transcription; only the resulting text is stored with your log
Deepgram's services are subject to their terms and privacy policy
Most other voice features in the App transcribe on-device and do not upload audio; the live voice call uses OpenAI (Section 8.3), not Deepgram

8.7 Apple Health (HealthKit) — Specific Commitments (iOS Only)
In addition to any general data commitments in the Privacy Policy, we specifically commit, in compliance with Apple's HealthKit requirements, that:

We will not use any data read from Apple Health for advertising, marketing, or similar services
We will not sell, rent, or otherwise commercialize any data read from Apple Health, nor disclose it to data brokers
We will not disclose any data read from Apple Health to third parties without your explicit permission, except as required to provide a service you have requested (for example, generating coaching by sending a short summary to an AI provider as described above) or as required by law
We will not use any data read from Apple Health for purposes other than providing health and wellness features within the App
Apple Health data is never shared with advertising, attribution, analytics, or in-app-ad providers (including Meta, Google Ads, Firebase Analytics, and Google AdMob)
You may revoke any Apple Health permission at any time in iOS Settings, and the App will continue to function (without those signals)
You may request deletion of Apple Health data stored on our servers at any time using the in-app delete control or by contacting us

8.8 Data Security
While we use reasonable security measures, you acknowledge that:

No system is 100% secure
You are responsible for device security (passcode, etc.)
You should not store extremely sensitive data in the App

9. Intellectual Property

9.1 Our Rights
All rights, title, and interest in and to the App, including:

Source code, object code, and software
User interface, design, and visual elements
"Pulse," "Wellness OS," and "WOS: AI Health Coach" names, logos, and branding
Features, functionality, and documentation
All content, graphics, and media
AI-generated coaching, insights, chat, and voice-call output formats (we retain rights to the format and delivery, though the personalized content is generated for you)
…are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

9.2 Limited License to You
We grant you a limited, non-exclusive, non-transferable, revocable license to:

Install and use the App on your personal iOS or Android device
Access features according to your subscription tier
Use the App for personal, non-commercial purposes
Use AI-generated coaching and insights for personal reflection only
You may NOT:
❌ Copy, modify, or create derivative works of the App
❌ Reverse engineer, decompile, or disassemble the App (except as permitted by law)
❌ Rent, lease, sell, sublicense, or distribute the App
❌ Remove or alter copyright notices or branding
❌ Use the App for commercial purposes without permission
❌ Republish, redistribute, or sell AI-generated coaching or insights

9.3 Your Content

You retain ownership of content you create (for example, display name, wellness logs, notes, meal photos, AI chat messages, voice-call recordings and transcripts, and Apple Health data shared with the App on iOS)
By using the App, you grant us a license to store, process, and display your content as necessary to provide the service
You grant us permission to send relevant context from your profile, logs, and (on iOS, if you have granted Apple Health access) short Apple Health summaries to third-party AI services (OpenAI, Anthropic, Google) to generate coaching, insights, chat, and voice-call responses
You grant us permission to stream your microphone audio to OpenAI during a live voice call, and to send your voice recordings to Deepgram for transcription when you use the longer-form voice features described in Section 4.5

10. Disclaimers

10.1 "AS IS" Service
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

10.2 No Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability, fitness for a particular purpose, and non-infringement
That the App will be uninterrupted, error-free, secure, or virus-free
That reminders, notifications, alerts, or live voice calls will always be delivered or connect
That scores, streaks, or insights will be calculated accurately in all circumstances
That logs or Apple Health data will sync correctly
That AI-generated coaching, insights, chat, or voice-call responses will be accurate, helpful, appropriate, or suitable for your needs
That third-party services (OpenAI, Anthropic, Google, Deepgram, Mixpanel, RevenueCat, Meta, Firebase, Google AdMob) will always be available
That the App will meet your requirements or expectations

10.3 No Medical or Safety Warranty
WE MAKE NO WARRANTY THAT:

The App will protect your safety or prevent harm
The App is suitable for emergency use or medical monitoring
AI-generated coaching or insights will improve your health, fitness, sleep, nutrition, hydration, fasting, or mental well-being
AI-generated content is medically accurate or appropriate
Apple Health values surfaced or interpreted in the App are clinically accurate

10.4 Third-Party Services Disclaimer
WE ARE NOT RESPONSIBLE FOR:

OpenAI, Anthropic, or Google AI service outages, errors, or inappropriate AI responses (including during voice calls)
Deepgram transcription errors, outages, or service disruptions
Mixpanel analytics inaccuracies or service disruptions
RevenueCat service outages or subscription verification failures
Meta (Facebook) SDK service outages, errors, or advertising attribution inaccuracies
Firebase Analytics / Google advertising attribution failures or inaccuracies
Google AdMob ad-serving errors, outages, or inappropriate ads (Android)
Apple Health / HealthKit framework changes, data inaccuracies, or sync failures
Any other third-party service failures or data handling

11. Limitation of Liability

11.1 No Indirect Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, goodwill, or business opportunities
Emotional distress, personal injury, or property damage
Damages arising from your use or inability to use the App
Missed reminders, failed notifications, dropped voice calls, or broken streaks
Harm resulting from reliance on the App for safety, emergency, medical, or mental health purposes
Harm resulting from reliance on AI-generated coaching, insights, chat, or voice-call responses
Harm resulting from reliance on Apple Health values surfaced or interpreted in the App
Damages caused by third-party services (OpenAI, Anthropic, Google, Deepgram, Mixpanel, RevenueCat, Meta, Firebase, Google AdMob)
…even if we have been advised of the possibility of such damages.

11.2 Total Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP IS LIMITED TO THE GREATER OF:
(a) The amount you paid for premium subscriptions in the last 12 months, OR
(b) $50 USD

11.3 Basis of the Bargain
You acknowledge that these limitations are an essential element of the agreement between you and us, and that we would not provide the App without these limitations.

12. Indemnification

You agree to defend, indemnify, and hold harmless us, our developers, affiliates, and service providers from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

Your use or misuse of the App
Your violation of these Terms
Your violation of any law or third-party rights
Content you provide (display name, profile information, wellness logs, AI chat content, voice-call content, Apple Health data shared with the App, etc.)
Your reliance on the App for safety, emergency purposes, or medical / mental health care
Your reliance on AI-generated coaching, insights, chat, or voice-call responses
Your reliance on Apple Health values surfaced or interpreted in the App

13. Termination

13.1 You May Terminate
You may stop using the App at any time by:

Uninstalling the App from your device
Canceling your premium subscription through Apple (iOS) or Google Play (Android)
Revoking Apple Health access in iOS Settings → Privacy & Security → Health → Wellness OS (iOS)
Deleting Apple Health data stored on our servers using the in-app delete control (iOS)
Deleting your account and all associated server-side data in the App via Settings → Delete account, or by contacting [email protected]

13.2 We May Terminate or Suspend
We may suspend or terminate your access immediately, without notice, if you:

Violate these Terms
Abuse features (spam, harassment, technical exploitation, AI misuse, ad or credit fraud)
Engage in fraudulent or illegal activity
Pose a security or legal risk to the service

13.3 Effect of Termination
Upon termination:

Your right to use the App ends immediately
Premium features are disabled (no refund for unused time)
On-device data remains until you uninstall the App
Server-side data may be deleted according to our Privacy Policy
We are not liable for any loss resulting from termination

13.4 Survival
Sections that by their nature should survive termination will survive, including: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Apple Health Specific Commitments, and Governing Law.

14. Legal Terms

14.1 Governing Law and Jurisdiction
These Terms are governed by the laws of the jurisdiction where the developer is located, without regard to conflict of law principles. However, your local consumer protection laws may provide additional rights that cannot be waived.

14.2 Dispute Resolution (Informal First)
Before filing any formal legal claim, you agree to:

This does not limit your right to seek emergency relief or enforcement of intellectual property rights.

14.3 Arbitration (if applicable)
Depending on your jurisdiction, disputes may be subject to binding arbitration. However, you may have the right to opt out or to pursue claims in small claims court.

14.4 Class Action Waiver
To the extent permitted by law, you agree that disputes will be resolved on an individual basis and waive the right to participate in class actions or class arbitrations.

14.5 Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the App and supersede all prior agreements or understandings.

14.6 Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

14.7 No Waiver
Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.

14.8 Assignment
You may not assign or transfer these Terms without our written consent. We may assign these Terms to any successor or affiliate.

14.9 Third-Party Beneficiaries
Apple and its subsidiaries are third-party beneficiaries of these Terms (see Section 14.10). OpenAI, Anthropic, Google, Deepgram, Mixpanel, RevenueCat, Meta, and Google AdMob are NOT third-party beneficiaries; they are service providers only.

14.10 Apple Requirements (iOS)
For the iOS version, these Terms are between you and us, not Apple. Apple is not responsible for the App or its content. However:

You must comply with Apple's App Store Terms of Service
Apple has no obligation to provide maintenance or support
Apple is not liable for any claims related to the App
In the event of third-party claims that the App infringes intellectual property, we (not Apple) are responsible
Apple and its subsidiaries are third-party beneficiaries of these Terms regarding your use of the App, and Apple may enforce these Terms
You must use Apple Health data in accordance with Apple's HealthKit guidelines and our Apple Health Specific Commitments in Section 8.7

14.11 Google Play Requirements (Android)
For the Android version, these Terms are between you and us, not Google. Your use of the App is also subject to the Google Play Terms of Service. Google is not responsible for the App or its content and is not a party to these Terms.

15. Changes to These Terms

15.1 Right to Modify
We reserve the right to modify these Terms at any time. Changes will be effective:

Immediately upon posting the updated Terms (with updated "Last Updated" date)
Or on a future date specified in the updated Terms

15.2 Notice of Changes
For material changes, we will make reasonable efforts to notify you:

Via in-app notification
Via email (if we have your email)
By prominent notice on our website or in the App

15.3 Your Acceptance
Continued use of the App after changes means you accept the updated Terms. If you do not agree to changes, you must stop using the App.

17. Acknowledgment

BY USING THE APP, YOU ACKNOWLEDGE THAT:
✅ You have read, understood, and agree to these Terms and our Privacy Policy
✅ You understand that the App is not an emergency service or medical device
✅ You understand that AI-generated coaching, insights, chat, and voice-call responses are for personal awareness and motivation only, not medical advice
✅ You understand that Apple Health values surfaced or interpreted in the App are for personal awareness and motivation only, not medical advice
✅ You will not rely on the App or AI-generated content as a substitute for professional medical or mental health care
✅ You will not rely on the App as the sole method for safety planning
✅ You are responsible for the accuracy of the profile information you provide
✅ You are responsible for testing notifications and ensuring the App works as expected for your needs
✅ You accept the risks and limitations described in these Terms
✅ You consent to relevant context from your profile, logs, and (on iOS, if you grant Apple Health access) Apple Health summaries being sent to third-party AI services (OpenAI, Anthropic, Google) to generate coaching, insights, chat, and voice-call responses
✅ You consent to your microphone audio being streamed to OpenAI during a live voice call, and to your audio being sent to Deepgram for transcription when you use the longer-form voice features described in Section 4.5
✅ You understand that sleep sound sensing processes microphone audio on your device and stores short snore clips only on your device
✅ You consent to anonymized usage analytics via Mixpanel
✅ You consent to your subscription status being managed and verified via RevenueCat
✅ You consent to advertising attribution data being processed by Meta (Facebook) and Google Firebase Analytics, subject to your App Tracking Transparency permission choice (iOS)
✅ You understand that the Android version shows in-app ads via Google AdMob, while the iOS version shows no in-app ads
✅ You understand that anonymous conversion signals are always sent to Apple's SKAdNetwork regardless of tracking permission, as required by Apple
✅ You understand that Apple Health integration is optional (iOS only), can be revoked in iOS Settings at any time, and that we will not use Apple Health data for advertising, sell it, or share it with data brokers
✅ You understand that Widgets and (on iOS) Live Activities may display summary scores and ongoing sessions on your Home and Lock Screens
