These Terms of Use ("Terms") govern your use of **Aeris** ("the App," "we," "our," "us"), a quit-vaping companion app for iOS distributed via the Apple App Store.

## 1. Who Can Use This App
### 1.1 Eligibility
The App is intended for existing nicotine users who want to quit, cut down, or track their vaping. You must be at least **17 years old** (consistent with the App's App Store age rating) and old enough to form a binding contract in your jurisdiction. The App is not directed to children.
### 1.2 Your Responsibilities
You are responsible for the accuracy of the information you enter, for keeping your device secure, and for using the App in compliance with these Terms and applicable law.

## 2. What We Provide
### 2.1 Core Features
- Craving, puff, and slip tracking with streaks, milestones, and money-saved estimates
- A personalized quit plan generated from your onboarding answers
- SOS craving-rescue tools (breathing exercises, games, and AI-generated insights)
- An in-app companion with AI-generated encouragement
- Optional Buddy matching and one-to-one chat with another user on a similar journey
- Optional local reminders and milestone notifications
- Availability in multiple languages
### 2.2 Premium Features
Some features require a paid **Aeris Premium** subscription (see Section 6). Free features, premium boundaries, and prices may change over time.
### 2.3 Feature Changes & Availability
We may add, change, or remove features at any time. We aim for high availability but do not guarantee the App will always be available, uninterrupted, or error-free. AI-generated content depends on third-party providers and may occasionally be unavailable.

## 3. No Medical Guarantee — Important Disclaimers
### 3.1 Not a Medical Device or Treatment
**THE APP IS NOT A MEDICAL DEVICE, AN APPROVED NICOTINE-CESSATION THERAPY, OR A HEALTHCARE SERVICE.** It is a motivational and habit-tracking companion. Nothing in the App is medical advice, diagnosis, or treatment.
### 3.2 AI Content Disclaimer
Plans, insights, whispers, companion messages, and other content are generated by artificial intelligence from the information you provide. AI content can be imperfect, generic, or wrong. It is for motivation and general information only — never rely on it for medical decisions.
### 3.3 Your Health Is Your Responsibility
Quitting nicotine can involve withdrawal symptoms. Consult a qualified healthcare professional about the right cessation approach for you, especially if you are pregnant, have a heart condition, mental health condition, or any condition affected by nicotine. **If you experience a medical or mental health emergency, contact emergency services immediately — do not rely on the App.**
### 3.4 Estimates Are Estimates
Money-saved, puffs-avoided, nicotine, dependence, and health-recovery figures are estimates computed from your own inputs and published averages. They are illustrative, not guarantees.

## 4. Buddy Feature & User Content
### 4.1 What It Is
The optional Buddy feature matches you with another Aeris user for mutual encouragement via one-to-one chat. Your display name, quit method, progress stats, and coarse country/region are visible to potential buddies.
### 4.2 Your Content
You retain ownership of the messages and text you submit. You grant us a limited, worldwide, royalty-free license to store, transmit, and display that content solely to operate the App (e.g., delivering your messages to your buddy).
### 4.3 Rules of Conduct
When using buddy chat (and the App generally), you must NOT:
- Harass, threaten, abuse, or demean anyone
- Send sexual, hateful, violent, or otherwise objectionable content
- Promote or sell vaping, tobacco, nicotine, or other products
- Spam, advertise, or solicit
- Share anyone's personal information without consent, or ask a buddy for personal/financial details
- Impersonate others or misrepresent yourself
- Attempt to harm minors in any way
### 4.4 Moderation & Safety
We may review, remove, or refuse any user content and may suspend or terminate access for violations, at our sole discretion, with or without notice. To report a buddy or content, use the in-app reporting/contact options — we act on reports within 24 hours. Do not share sensitive personal data in chat; messages are visible to your matched buddy.

## 5. Personalization and Your Data
Your onboarding answers personalize your plan, insights, and reminders. Providing inaccurate information will produce less useful results. Data handling is governed by our **Privacy Policy**, which is incorporated into these Terms. Key points: no account or email is required; your data is stored under an anonymous device ID; AI content is generated by sending relevant context to our AI provider (OpenAI); analytics (Mixpanel) can be disabled in Settings; and you can permanently delete your data anytime via Settings → Delete my data.

## 6. Subscriptions & Payments
### 6.1 Apple Billing
All purchases are processed by Apple through your Apple ID. We never receive or store your payment details. Subscription management is provided by RevenueCat on our behalf.
### 6.2 Plans
Aeris Premium is offered as auto-renewing subscriptions (for example, Yearly and Monthly). Current prices are always shown in the App and in the App Store before you buy. Prices vary by region and may change; changes apply only to subsequent renewal periods.
### 6.3 Free Trial
A plan may include a free trial (for example, 3 days on Yearly). **One trial per user/device.** Unless you cancel at least 24 hours before the trial ends, the subscription starts automatically and your Apple ID is charged.
### 6.4 Auto-Renewal & Cancellation
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Cancel anytime: **iOS Settings → Apple ID → Subscriptions → Aeris**. Deleting the App does NOT cancel a subscription. After cancellation, Premium remains active until the end of the paid period.
### 6.5 Refunds
Purchases are billed by Apple, and refunds are handled exclusively by Apple under its policies. Request at <https://reportaproblem.apple.com>. We cannot issue refunds directly.
### 6.6 Restore
Use "Restore purchases" in the App to re-activate Premium on a new or reinstalled device using the same Apple ID.

## 7. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or tamper with the App or its servers
- Access or attempt to access another user's data
- Abuse, overload, scrape, or disrupt our APIs or infrastructure
- Use the App for any unlawful purpose
- Circumvent subscription, trial, or feature restrictions
- Use automated systems to access the App

## 8. Intellectual Property
The App — including its design, code, companion characters, animations, text, and AI-generated content presented in it — is owned by us or our licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on Apple-branded devices you own or control, in accordance with the Apple Media Services Terms.

## 9. Disclaimers
THE APP IS PROVIDED **"AS IS" AND "AS AVAILABLE"** WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL HELP YOU QUIT VAPING, THAT CONTENT (INCLUDING AI CONTENT) WILL BE ACCURATE, OR THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. THIRD-PARTY SERVICES (APPLE, GOOGLE, OPENAI, REVENUECAT, MIXPANEL, FLY.IO) ARE OUTSIDE OUR CONTROL AND CARRY THEIR OWN TERMS.

## 10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL; AND (b) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (OR US $10 IF YOU PAID NOTHING). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME MAY NOT APPLY TO YOU.

## 11. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the App, or content you submit.

## 12. Termination
- **You** may stop using the App anytime and delete your data via Settings → Delete my data
- **We** may suspend or terminate your access (including buddy features) if you violate these Terms, abuse the service, or where required by law
- Sections 3, 4.2, 8–11, and 13 survive termination. Termination does not entitle you to a refund (see Section 6.5)

## 13. Legal Terms
### 13.1 Governing Law
These Terms are governed by the laws of the jurisdiction where the developer is located, without regard to conflict-of-law principles. Your local consumer-protection laws may provide additional rights that cannot be waived.
### 13.2 Disputes — Informal First
Before filing any claim, contact us at [email protected] — most issues can be resolved quickly and informally. Any dispute not resolved informally shall be brought in the courts of the jurisdiction where the developer is located, unless your local law provides otherwise.
### 13.3 Miscellaneous
If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger or sale. These Terms plus the Privacy Policy are the entire agreement between you and us regarding the App.
### 13.4 Apple-Specific Terms
These Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the App and is not responsible for any product warranties, claims (including product liability, legal compliance, or IP claims), or investigations related to the App. In case of the App's failure to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-party list.

We may update these Terms as the App evolves. We will update the "Last Updated" date above and, for material changes, may provide in-app notice. Continued use after changes means you accept the updated Terms.
